Latest Update: 10/30/2019 – As ordered by the court's decision in National Women's Law Center, et al., v. Office of Management and Budget, et al., Civil Action No. 17-cv-2458 (D.D.C.), EEO-1 filers must submit Component 2 data for calendar year 2017, in addition to Component 2 data for calendar year 2018, by September 30, 2019. The EEOC has previously stated that, consistent with its current practice regarding Component 1 data, it will continue to collect Component 2 data for a six-week period after September 30, 2019, through November 11, 2019.

Most recently, however, on October 29, 2019, the court ordered the EEOC to “take all steps necessary to complete the EEO-1 Component 2 data collection for calendar years 2017 and 2018 by January 31, 2020.” Therefore, until further notice, the data collection will remain open past November 11, 2019. Employers who have not yet filed should do so as soon as possible.
Update: 10/24/2019 – As put forth in its October 8, 2019 Motion to the court in National Women’s Law Center, et al. v. Office of Management and Budget, et al., Civil Action No. 17-cv-2458 (D.D.C.) discussing post-September 30th activities, the EEOC stated that, consistent with its current practice regarding Component 1 data, it will continue to collect Component 2 data for a six-week period after September 30, 2019. The six-week period following September 30, 2019 is set to expire November 11, 2019. The EEOC has requested from the court an order confirming that the Component 2 data collection is otherwise complete. As a result, November 11, 2019 may be the last date EEO-1 eligible filers can submit and certify their Component 2 EEO-1 reports for 2017 and 2018. The EEOC encourages all filers to submit their data as soon as possible.
Update: 9/27/2019 – In a September 27, 2019 Status Report that was filed in the lawsuit discussing post-September 30th activities, the EEOC stated that so long as the Court’s order is in effect stating that the collection will not be complete until it reaches what the Court has determined to be the target response rate, the EEOC will continue to accept Component 2 data for 2017 and 2018. EEO-1 eligible employers should continue to submit and certify their Component 2 EEO-1 reports for 2017 and 2018 as soon as possible.
